The Jacksonville Jaguars first round draft pick, wide receiver Justin Blackmon, was arrested for aggravated DUI this morning in Stillwater, Okla..
The timing of the arrest is more stunning as he was booked in Payne County Jail at 10 a.m.. Even more stunning is Blackmon’s blood-alcohol level — .24, three times the legal limit. Hence the aggravated DUI charge.
According to okdui.com “Oklahoma has a statute making any DUI where the driver has a blood or breath alcohol level of .15 or more an Aggravated DUI. At least one Judge has ruled this statute unconstitutional and as a result, if the charge is filed as an aggravated DUI, the District Attorney will most always amend to a regular DUI charge. This is preferable as Aggravated DUI carries mandatory 28 day alcohol and drug in-patient treatment.”
Blackmon, 22, was arrested in 2010 in Carrolton, Texas for DUI at 3:45 a.m., and could be considered a ‘repeat offender’ with his latest arrest. Judges and district attorneys are less inclined to reduce charges and/or plea bargain with repeat offender defendants.
